Correct me if I'm wrong but I thought that the Freethinkers were allowed to put up a monument with the Treaty of Tripoli because, although the state had precedent on it's side, it did not want to spend the the money on litigation. The article makes it seem like it's about the removal of the monument, not the ability to put up other monuments.

This might be a waste of money for both sides. Supreme Court already decided this case in Van Orden v. Perry in 2005. I don't think the details of this case differ too much from that one.

I can sympathize with the fact that politicians are often afraid to take risks like this, but that's not to say that there's no argument for timing. Public opinion has to be at the right pitch before something like this gain a lot of ground, otherwise it could cause the party to lose credibility. I agree with a lot of the points that people brought up, but with the amount of spin that's been seen in recent elections, and with national attention in the form of super PAC dollars coming into the state, I'm just worried that it's poor timing.

I understand your point, but the demographics of this state are far different from the F-M community. This state has a large population of socially conservative rural residents who are very much skeptical of change. I'm not saying this is going to shift the election one way or the other, just that I think it has the potential to if the GOP frames it in the right way. While I agree that marijuana might not be a liberal thing anymore, it is still an issue very much divided by age, and ND has a large population of senior residents.

I understand that, but with things as slow to change as they are in ND think that, especially in the rural areas, still see anything dealing with marijuana is still viewed as a liberal issue, and a radically liberal issue at that. I understand that a lot of people in Fargo and GF might think that the general sentiment is that marijuana isn't such a big issue anymore, but I think that there is potential for this to be framed in a way that would deter independents from voting democrat in a socially conservative state.

I don't really agree with that. The race for Conrad's seat is actually pretty close right now, and if the ND GOP can look to this type of proposal and frame it as the way that democrats operate, there's much less chance that Heikamp will get elected by social conservatives.

I'm not sure this is the best timing for something like this. In ND, in a pretty contested presidential election year, this type of initiative helps cement the "radical liberal" stereotype. Don't get me wrong, I understand that this idea shouldn't be labeled "radical" and a discussion should definitely be made. I also understand that the proposal isn't to legalize or decriminalize marijuana. However, I'm still a little concerned of the way it will be framed by the social conservatives that occupy the majority of the state.
