The best evidence that we have indicates that traditional acupuncture is no more effective than sham acupuncture, i.e. sticking needles in superficially and at random, nor is it more effective than using retracting needles. Claiming that the benefits of acupuncture are due to the placebo effect isn't "presumptuous"; it's in line with the majority of medical studies. While the evidence isn't quite conclusive, it is rather one-sided.

EDIT: Also, most of the Framers can, at best, be said to have turned a blind eye to human slavery and I haven't found evidence that any of them supported women's suffrage. Are their opinions on those issues relevant?

As the federal government did not have an Office of Education until 1867 and the idea of incorporation practically didn't exist before the 1920's, I'd say that whatever the Founding Fathers thought on the issue is completely irrelevant to the modern Constitution.

If you're at all concerned with the constitutionality of an action, then you must also be concerned with the relevant case law. The "interpretations" you mention are not those of jurists, but the Supreme Court. Seeing as the Supreme Court alone has ultimate authority on issues of constitutionality, I don't see how you can differentiate between the "constitutional argument" and the "constitutional interpretation" of the Supreme Court.

It seems that you're suggesting that it's acceptable to downvote honest questions and not give any answer because it's frustrating that not everyone has read the very extensive collection of links (50+) on the sidebar before posting. That seems rather counterproductive. The OP gets no advice and still won't know why his post was downvoted. Why not leave a comment and try to help him?

I'm not saying that you shouldn't downvote those sorts of posts- if they don't contribute to the community, they absolutely deserve a downvote- but everyone would benefit from the people who make these sort of posts knowing why their posts aren't useful.
