Yes, like most of the others are saying, it typically involves some form of classtime, then a test from that organization (at least in NY), then a State test to be "licensed." But even then, you're not technically licensed until you're sponsored by a broker. NY state has a state page dedicated to Real Estate Professionals that outlines requirements. Try Googling "Your State Real Estate Professionals," and look for the results from state and city sites. Good luck!

Should I save the moral debate for $1,000 refund? $100,000? In principle, I don't understand where the monetary value makes a difference. The principle is to refund gratuitously. I know bar owners in the city that struggle over their next alcohol order, and wonder if the ConEd bill will be under $1500 that month. Should they not own a bar anymore?

I think the $120 in lost potential profit matters to most business owners that are making ends meet.

The point is that the short term pain of refunding, fosters longer customer relationships that will pay out more in the long run. It is focused on customer perspective, and not one of owner scarcity.

Tis all. I seem to have lost my message in transmission, so I'll own that and find a better way next time.

It's been addressed well here so not much to add to it. I will note that the successful agents I watched in the two firms I worked with put in LOTS of hours. It's really pretty consuming to stay up to the minute with your customers. Technology makes it very easy for them to bounce to another agent who is standying by his email via smart phone ;)

You have to hang your Salesperson License with a Licensed Broker. It's important to distinguish here though that "Realtor" is an additional title that means you are a part of their private union (for lack of a better word.) Many Real Estate Agents are not Realtors, especially starting out, because of the annual dues.

No experience with them in NYC, I do agree with Semper03 though. It will boil down to you anyway. You don't have to pester your friends and family ad nausea, but as many veterans point out, if someone around you doesn't know that you're a real estate professional, you've missed something along the way.

More particularly, the business practices of Nike and Hilton, compared with another end of the spectrum where someone never refunded based on technicality. And it is definitely a rant. Thanks for taking the time to review it.

You make the same point I'm making. And if you literally reach in your pocket to refund someone, that was money in your pocket, whether it was "yours" or not in principle.

Yeah, like None_Shall_Pass says, I don't see the advantage in getting around the business checking. You're still opening another account. I opened one with Capital One, two with them actually, they got rid of the 100% free-and-clear simple checking, but that have one comparible that is no-fees, and no hassle as long as you don't exceed a certain amount of transactions.

If the portfolios and report are good, I don't necessarily care about "experience." I also recommend that you send improvements to owners with sites. Redo something for them, but not a complete project, and then tell them what else you can do for what price.

The Hilton experience made me a firm believer on that. I was ready to devote an entire day to telling everyone how bad the check-in was, but the bottle of wine, and quick correction actually outweighed the neg.

If you have confidence in the deal, it's not a gigantic issue. Just make sure the cost of them staying in the house is above market rent rate so there is no compelling arbitrage incentive to stay, like Joshua points out.

I was going to iterate what Joshua said, also. You have a lawyer already, so take the lawyer's word over mine, but in NY this does create a tenancy situation...and in NY those laws HIGHLY favor the tenant, even in the worst case scenario where they stop paying.

I had a deal fall through in Long Island because seller couldn't close in time, and we considered a similar agreement to move in until he could close. The daily "fee" is just prorated rent, and had I stiffed him on the close, we would have been tenants.

It's not an impossible agreement, but just know that when someone is living in a house you own (room mate, extended house guest, former owner) and there is consideration involved (daily fees, them paying your mortgage), in most places this is a tenant situation, and those laws apply.

But I'm not a lawyer.
